1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of Nichefy.one, related applications, and services provided under the Nichefy name (together, the “Service”).

By creating an account, purchasing access, or using the Service, you agree to these Terms and our Privacy Policy. If you use Nichefy for an organization, you represent that you are authorized to bind that organization. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old and legally able to enter into these Terms. If local law requires a higher minimum age, that higher age applies. Users under the age of legal majority must have permission from a parent or legal guardian.

3. The Service

Nichefy provides tools for YouTube niche and audience research, content intelligence, creative development, production coordination, performance learning, and related workflows. Features may analyze market or channel signals and help generate recommendations, briefs, scripts, visuals, packaging ideas, or other outputs.

Features, limits, supported platforms, and availability may change as the Service evolves. Beta or preview features may be less reliable and may be changed or removed without notice.

4. Accounts and access

You must provide accurate account information, keep credentials confidential, and promptly update information that changes. You are responsible for activity under your account and for configuring access granted to team members.

Notify us promptly if you suspect unauthorized access. You may not share, sell, or transfer account access except through team features expressly provided by Nichefy.

5. Subscriptions, billing, and cancellation

Some features may require a paid plan. Prices, included usage, billing intervals, renewal terms, and taxes are shown at checkout or in the applicable order. Unless stated otherwise, recurring plans renew automatically until canceled.

You can cancel before the next renewal through available account controls or by contacting us. Cancellation stops future renewals but does not retroactively refund the current billing period unless required by law or stated in the offer. We may change pricing or plan limits with reasonable notice before the change applies to an existing recurring plan.

6. Your content and permissions

You retain ownership of prompts, briefs, scripts, brand materials, media, and other content you submit to the Service (“User Content”), subject to rights held by others.

You grant Nichefy a non-exclusive, worldwide, royalty-free license to host, copy, process, modify, transmit, and display User Content only as needed to provide, secure, and support the Service and the features you request. You represent that you have the rights and permissions needed for your User Content and our processing of it.

7. AI-assisted outputs and your responsibility

Nichefy may use automated and AI-assisted systems. Outputs can be incomplete, inaccurate, outdated, similar to material produced for others, or unsuitable for your intended use. Nichefy does not guarantee originality, factual accuracy, legal clearance, platform compliance, performance, views, revenue, or audience response.

You are responsible for reviewing outputs, checking facts and sources, obtaining necessary rights and permissions, applying appropriate disclosures, and making the final decision to publish or use content.

8. Acceptable use

You may not use the Service to:

• Violate law, third-party rights, platform rules, or contractual obligations.
• Create, upload, or distribute unlawful, fraudulent, defamatory, harassing, exploitative, or infringing material.
• Impersonate a person or misrepresent synthetic or manipulated media where disclosure or consent is required.
• Introduce malware, disrupt the Service, probe security without authorization, or bypass access and usage limits.
• Reverse engineer, copy, scrape, resell, or commercially exploit the Service except as allowed by law or written permission.
• Use automated access that creates unreasonable load or interferes with other users.
• Use outputs as a substitute for professional legal, financial, medical, or other regulated advice.

9. YouTube and third-party services

The Service may link to, retrieve permitted data from, or integrate with YouTube and other third-party services. Your use of those services remains subject to their own terms, policies, permissions, and technical limits.

Nichefy does not control third-party services and is not responsible for their content, availability, policy changes, account decisions, or data practices. A third-party integration may stop working if the provider changes or revokes access.

10. Nichefy intellectual property

The Service, software, interfaces, designs, models, workflows, documentation, trademarks, and other Nichefy materials are owned by Nichefy or its licensors and protected by intellectual property laws.

Subject to these Terms, Nichefy grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose during your authorized access period. No other rights are granted by implication.

11. Feedback

If you provide ideas, suggestions, or feedback about Nichefy, you allow us to use them without restriction or compensation. This does not transfer ownership of your separate User Content.

12. Availability and changes

We work to keep Nichefy available but do not guarantee uninterrupted or error-free operation. Maintenance, security incidents, provider outages, or changes to third-party platforms may affect access.

We may modify, suspend, limit, or discontinue features. When a change materially reduces a paid Service, we will provide notice when reasonably possible.

13. Suspension and termination

You may stop using Nichefy at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, fail to pay amounts due, misuse the Service, or if continued operation is no longer commercially or technically feasible.

Where appropriate, we will give notice and an opportunity to cure. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and payment obligations—will survive.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Nichefy disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

Market signals and recommendations are informational. Trends change, historical performance does not predict future results, and no feature guarantees growth, monetization, rankings, views, subscribers, or commercial outcomes.

15. Limitation of liability

To the fullest extent permitted by law, Nichefy and its affiliates, suppliers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or business interruption arising from the Service.

To the fullest extent permitted by law, aggregate liability arising from the Service will not exceed the greater of the amount you paid to Nichefy for the Service during the 12 months before the event giving rise to the claim or US $100. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

16. Changes to these Terms

We may update these Terms as the Service changes. We will post revised Terms here, update the “Last updated” date, and provide additional notice when required or when a change is material. Continued use after the effective date means you accept the revised Terms.

17. General terms

If any provision is unenforceable, the remaining provisions stay in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Service. These Terms and referenced policies form the entire agreement about the Service unless a separate written agreement applies.
